Trump allies say he declassified Mar-a-Lago documents
The Justice Department has a track record of prosecuting cases that involve the improper handling of classified information. However, this has never been done against a former president before. This raises questions about the possibility of bringing such a case against Donald Trump, who served as the President of the United States from 2017 to 2021.
According to Charles Stimson, a former federal prosecutor and a senior fellow with the Conservative Heritage Foundation, Trump's potential defense could be that he had declassified the documents in question. Stimson argues that Trump would likely assert that he is not in possession of any classified information currently. While this may seem like a strong defense, it remains to be seen if it would hold up in court.
